Directors’ duties, emerging liability risks,
and insurance protection
In this session we cover the key duties directors need to have in mind in a distressed scenario. We look in
particular at the obligation on directors to factor into their decision making the interests of creditors where
companies are in the 8twilight zone9 when insolvent liquidation or administration may be on the
