Legal professional privilege and navigating
disclosure risks in a global context
This session provided a valuable refresher on legal professional privilege under the laws of England and
Wales, summarising the core elements of legal advice privilege, litigation privilege, and the ways in which
privilege can be preserved, shared, or ultimately, lost.
The session had a particular focus on recent case law developments in this evolving landscape, as well as
calling out some of the practical impacts of technological developments and the ever-changing ways in which
corporations operate. We also drew on our experience of working with clients across industry sectors and
jurisdictions to give some practical guidance on managing internal and external communications and
preserving privilege.
We concluded by addressing some of the additional challenges of differing jurisdictional rules, calling out
some international considerations that will help organisations manage disclosure risks in a global legal
environment.
