Palmer where we discussed How to Build a Climate-Resilient Business. Senior associate Amy Cleaves
moderated the session.
A key focus of the session was the importance of scenario planning as a dynamic tool to develop adaptive
and useful climate resilience strategies that guide but do not restrict a business9s operations. Marion spoke
about how legal and sustainability teams are essential to develop resilience measures that go beyond
immediate legal requirements and anticipate long-term challenges and opportunities.
Malcolm discussed how traditional 8boilerplate9 clauses now require far more focus from legal teams, as
provisions such as force majeure and change in law relate to climate disasters, extreme weather events and
climate-related policy developments. The panel emphasised the need for businesses to future-proof
agreements by engaging with the specific risk profile of their supply chain and incorporating protections
against climate-related disruptions and shifting regulations.
Another theme of the discussion was the importance of insurance coverage. Lydia highlighted that
businesses should consider both the physical risks and liability risks that arise in the context of climate
change. The need for companies to explore innovative risk transfer strategies, such as parametric
insurance, to ensure protection in an uncertain and rapidly evolving climate landscape was another key
element Lydia touched on.
