Emerging technology: opportunities and
risks
This cross-practice session, featuring insights from our Fintech team and Commercial Litigation team, offered an
overview of the evolving legal and regulatory landscape surrounding emerging technologies, highlighting novel
compliance, contractual and dispute risks to bear in mind.

On AI, we discussed different use cases, from enhancement of services offered by a variety of
organisations to the use of AI agents by clients/consumers, as well as litigation risks arising from input data
use and Gen-AI output errors, with a focus on identifying practical tips to mitigate AI-related risks
alongside adoption.

On digital assets and DLT, we examined legal and regulatory uncertainties around both (1) digital assets
and (2) the underlying technology (e.g. DLT and smart contracts). We also examined the features of digital
assets most likely to present novel challenges for the English courts, including in particular the question
whether software developers might be found to owe fiduciary (or any other) duties to holders of digital
assets.

Finally, we discussed ongoing initiatives in the UK to foster the development of smart data schemes and to
expand on the success of Open Banking such as the Data (Use and Access) Bill, and highlighted the
potentially important role that cross-sector regulatory collaborations has to play in mitigating fraud risk in
the context of data-sharing scheme adoption.
